Terms of Service

1. Acceptance of Terms
By accessing or using Gamble Ad (the "Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to everyone who uses the Service, whether as a publisher, an advertiser, or both.
2. Description of Service
Gamble Ad is a two-sided advertising platform for the iGaming industry. It comprises:
- An ad-serving platform for publishers, which displays geo-targeted offers to visitors of registered publisher websites via a widget.
- A marketplace exchange, in which advertisers fund a wallet and bid to have their offers served across the publisher network, and publishers earn a share of the resulting revenue.
Impressions are priced by a second-price auction: the winning advertiser pays a clearing price based on the next-highest competing bid, subject to any publisher floor. The clearing price is fixed at the time an impression is served.
3. Eligibility and Accounts
To use the Service, you must:
- Be at least 18 years old and legally able to enter into contracts;
- Provide accurate, complete registration information and keep it up to date;
- Maintain the security of your account credentials;
- Accept responsibility for all activity under your account.
You are responsible for ensuring that your own use of the Service, and the promotion of any gambling products through it, is lawful in every jurisdiction in which you operate.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Violate any applicable law or regulation;
- Promote gambling in jurisdictions where it is prohibited, or to persons below the legal age;
- Display misleading, deceptive, or fraudulent advertising;
- Generate or facilitate invalid, artificial, incentivised, or fraudulent traffic, impressions, or clicks, including through bots, automated scripts, or click farms;
- Attempt to manipulate the auction, pricing, settlement, or earnings;
- Interfere with, disrupt, or attempt to gain unauthorised access to the Service.
5. Responsible Gambling and Regulatory Compliance
You are solely responsible for ensuring your use of the Service complies with all applicable gambling, advertising, and consumer-protection regulations in the jurisdictions where offers are displayed, including:
- Displaying appropriate age restrictions and responsible-gambling messaging;
- Promoting only licensed operators in regulated markets;
- Restricting offers to jurisdictions where they are lawful.
Advertisers warrant that the offers, creatives, and destinations they submit are licensed and compliant in every geography they target. Publishers are responsible for the lawful operation of the sites on which they display the widget.
6. Advertiser Terms
- Wallet funding. Advertisers add funds to a prepaid wallet via our payment processor. Wallet funds are advertising credit for use on the Service and are not a deposit account or e-money.
- Spending. As your campaigns win auctions and are served, the applicable clearing price is deducted from your wallet. You may set bids and daily pacing caps; delivery volume is not guaranteed.
- Promotional credit. Any deposit or top-up bonus is promotional advertising credit, may carry conditions, is non-withdrawable, and may be withdrawn or adjusted in cases of abuse.
- Refunds. Amounts already spent on served impressions are non-refundable. Unspent wallet funds may be refundable at our discretion, less any costs and any promotional credit.
- Chargebacks. Initiating a chargeback on funds already spent is a breach of these Terms and may result in suspension and recovery of the amount owed.
7. Publisher Terms and Earnings
- Earnings. Publishers earn a share of the clearing price for each qualifying unique served, after deduction of the platform fee (see Section 8). Earnings shown before settlement are estimates and are not final until settled.
- Invalid traffic. Earnings arising from invalid, artificial, or fraudulent traffic will not be paid, and we may hold, adjust, reverse, or claw back earnings we reasonably determine to be affected.
- Withdrawals. You may request a withdrawal of your available balance once it meets the minimum payout threshold. Payouts are processed manually and may take time. Supported payout methods (which may change) include PayPal, bank transfer, and USDT (TRC-20). You are responsible for providing accurate payout details; we are not liable for funds sent to details you provided incorrectly.
- Taxes. You are responsible for any taxes due on your earnings.
8. Platform Fee
We retain a platform fee (take rate) from the cleared price of each settled transaction; the balance is credited to the publisher as earnings. The current take rate is made available to you through the Service and may change with reasonable notice.
9. Invalid Traffic and Fraud
We operate fraud and invalid-traffic controls. We may place holds on settlement, decline to pay affected earnings, reverse credited amounts, suspend accounts, and take other reasonable steps to protect advertisers, publishers, and the integrity of the marketplace.
10. Payments and Processors
Advertiser deposits are processed by our third-party payment processor (Stripe). We do not store full card details. Your use of payment and payout services is also subject to the terms of the relevant processor.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
12. Intellectual Property
The Service, including its content, features, and functionality, is owned by Gamble Ad and protected by intellectual-property laws. You retain rights to the creatives and content you submit and grant us a licence to host and serve them for the purpose of providing the Service.
13. No Guarantee
We do not guarantee any particular level of ad delivery, traffic, revenue, or earnings. The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.
14. Limitation of Liability
To the maximum extent permitted by law, Gamble Ad shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business, arising from your use of the Service.
15. Indemnification
You agree to indemnify and hold harmless Gamble Ad from any claims, damages, losses, or expenses arising from your use of the Service, the content or offers you submit, or your violation of these Terms or applicable law.
16. Termination
We may suspend or terminate your account for breach of these Terms or suspected fraud. On termination, your right to use the Service ceases. Subject to any fraud review and amounts owed, settled publisher earnings remaining above the minimum payout threshold may be withdrawn, and refundable unspent advertiser wallet funds may be returned, in each case at our reasonable discretion.
17. Changes to These Terms
We may modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of the United Kingdom, without regard to conflict-of-law provisions, and the courts of the United Kingdom shall have exclusive jurisdiction.
